Legal Obligations

Network Rail is committed to working collaboratively with partner organisations to enhance railway incident response and risk management. This includes the provision of:

  • briefing videos, and other training materials,
  • risk assessment and policy templates, as developed by the British Transport Police (BTP) or other Emergency Services,
  • a map displaying Route Control coverage and their emergency contact numbers,
  • and other additional documents, information, and advice,

all of which will support improved efficiency and effectiveness in railway incident response and risk management.

It is acknowledged that significant efforts are underway across the sector to enhance awareness and safety on the railway. It is important to emphasise that organisations have existing legal responsibilities to identify and manage risks for their employees, and to provide their staff with appropriate information and instruction for their safety, whether working through Rail SAFE, collaboratively, or independently.

Statutory duties to identify, assess, and mitigate risks and to ensure that staff are appropriately briefed and equipped to manage those risks, remain unchanged and must continue to be fulfilled in accordance with applicable legislation (E.g., Health and Safety at Work etc. Act 1974, the Management of Health and Safety at Work Regulations 1999, Human Rights Act 1998).
